Notice. Workers have two business days to inform the employer of their sick leave. Precedent indicates that in a society like ours, people usually have a social network of family members or friends that can inform the employer of such sick leave.
Type of Income. The amounts that a person receives during sick leave, both from CCSS and from the employer, is not salary. The correct term is subsidy. Therefore, these cannot be used to calculate severance or other calculations based on the salary earned.
Amount of the Subsidy. During the first 3 days of sick leave, the employer will bay 50% of the Employee’s salary.
As of the fourth day of sick leave, the amount of the subsidy is 60% of the salary reported for the employee
Employer Obligation. The employer does not have the obligation to cover the remaining 40%. Many work centers have policies setting the additional percentage to be paid by the company, that may even vary depending on the length of the sick leave or of the specific conditions of the case.
Exceptions. There are 2 exceptions to the amount of the subsidy: maternity leave where the employer pays 50% and CCSS the remaining 50% as of the first day and leave to care for a family member who is terminal or a minor with a serious illness
Effects. For all legal effects, the employment contract is suspended during these leaves.
Social Security Payments: Because amounts paid by the CCSS and by the employer during leaves is not salary, neither social security payments nor taxes will be paid.
